TERMS AND CONDITIONS

By purchasing, enrolling in, accessing, or participating in the Fear to Function Program (“Program”), operated by Face the Change, LLC (“Company,” “we,” “our,” or “us”), you (“Participant” or “you”) agree to the following Terms and Conditions (“Agreement”).
Please read these Terms carefully before participating in the Program.
1. EDUCATIONAL PURPOSE ONLY
Fear to Function is an educational and coaching-based program intended for informational purposes only.
The Program provides education related to:
stress responses;
behavioral patterns;
emotional wellbeing;
mindset;
self-regulation;
nervous system education;
lifestyle habits; and
personal development.
The Program is not medical care, mental health treatment, psychotherapy, counseling, physical therapy, healthcare, or any licensed clinical service.
Nothing within the Program should be interpreted as:
medical advice;
psychological treatment;
diagnosis;
healthcare services;
psychiatric care;
individualized treatment recommendations; or
professional therapeutic services.
Participation in the Program does not establish:
a therapist-client relationship;
provider-patient relationship;
coach-client healthcare relationship; or
any protected clinical relationship.
Although the creator may hold professional licenses or credentials, all information provided within the Program is offered solely in an educational capacity and not as licensed healthcare treatment.
The Program is not a substitute for medical care, psychotherapy, counseling, psychiatric treatment, or individualized healthcare services.
You are responsible for consulting your own licensed healthcare providers regarding your personal medical, psychological, or health-related concerns.
2. HEALTH AND MEDICAL DISCLAIMER
The Program discusses topics related to stress, chronic symptoms, emotional experiences, nervous system education, behavioral responses, and wellbeing.
However, Face the Change, LLC does not diagnose, treat, cure, or prevent any disease, condition, or disorder.
You acknowledge and agree that:
no physical, emotional, psychological, or symptom-related outcomes are guaranteed;
results vary from person to person;
participation is voluntary;
all decisions and actions taken based on Program content are your sole responsibility.
You should never disregard professional medical advice or delay seeking professional treatment because of information provided within the Program.
You should not discontinue medications, therapies, or healthcare services without consulting your licensed healthcare provider.
If you are experiencing a medical or mental health emergency, contact emergency services or an appropriate healthcare professional immediately.
3. ASSUMPTION OF RISK
You understand that discussions surrounding stress, chronic symptoms, emotional experiences, behavioral patterns, and nervous system education may feel emotionally activating, uncomfortable, or challenging.
By participating in the Program, you voluntarily assume full responsibility for:
your participation;
wellbeing;
emotional responses;
decisions;
actions; and
results.
You acknowledge that participation in educational discussions regarding stress, symptoms, and emotional wellbeing carries inherent personal risk.
To the fullest extent permitted by law, you agree that Face the Change, LLC shall not be liable for outcomes arising from your participation in the Program.
4. NO INDIVIDUALIZED PROFESSIONAL SERVICES
Participation in the Program does not entitle participants to individualized psychological, medical, therapeutic, clinical, or crisis support.
Communication through:
email;
community platforms;
social media;
messaging apps;
live calls;
comments; or
direct messages
does not establish a therapeutic or healthcare relationship.
The Program is not designed for:
crisis support;
emergency care;
individualized mental health treatment; or
medical intervention.
If you require individualized care or are experiencing a crisis, contact a licensed healthcare provider or emergency services immediately.
5. PARTICIPANT CONDUCT
We are committed to maintaining a respectful, supportive, and safe learning environment.
Face the Change, LLC reserves the right, at its sole discretion, to suspend, restrict, or terminate participation in the Program without refund if a participant:
becomes disruptive, abusive, threatening, or inappropriate;
violates community guidelines;
harasses facilitators or participants;
engages in discriminatory or harmful behavior;
shares confidential information from the Program; or
negatively impacts the Program environment.
Participants agree to communicate respectfully within all Program spaces.
6. CONFIDENTIALITY
Participants agree to maintain the confidentiality and privacy of other participants.
You agree not to share:
personal stories;
screenshots;
recordings;
identifying information; or
confidential discussions
shared by other participants within the Program.
While Face the Change, LLC encourages confidentiality within the community, we cannot guarantee that all participants will maintain confidentiality.
7. INTELLECTUAL PROPERTY
All Program content and materials are the intellectual property of Face the Change, LLC and are protected by copyright and intellectual property laws.
This includes, but is not limited to:
videos;
trainings;
worksheets;
PDFs;
graphics;
frameworks;
branding;
logos;
educational methods;
recordings; and
written materials.
Your enrollment grants you a limited, non-transferable, revocable license for personal use only.
You may not:
reproduce;
distribute;
share;
upload;
republish;
teach;
sell;
copy;
modify; or
create derivative works from Program materials
without prior written consent from Face the Change, LLC.
Unauthorized use may result in immediate removal from the Program and possible legal action.
8. MEDICAL DISCLAIMER
The Program is intended for educational and informational purposes only and is not medical, psychological, psychiatric, therapeutic, or healthcare treatment. Participation in the Program does not establish a therapist-client, physician-patient, coaching-client, or other professional relationship between you and Face the Change, LLC beyond the scope of the educational services provided.
The content provided through the Program, including but not limited to videos, coaching, community discussions, written materials, and resources, is not intended to diagnose, treat, cure, or prevent any disease, medical condition, or mental health condition.
You acknowledge that you are voluntarily participating in the Program and are solely responsible for your physical, mental, and emotional well-being, decisions, actions, and results.
You should consult with a qualified healthcare professional regarding any medical, psychological, psychiatric, or health-related concerns before making changes related to your treatment, medications, movement, exercise, nutrition, lifestyle, or healthcare decisions.
Individual experiences and results may vary. Face the Change, LLC makes no guarantees regarding specific outcomes, symptom improvement, healing, recovery, or personal results from participation in the Program.
9. PROGRAM STRUCTURE AND ACCESS
Fear to Function is a 90-day educational and coaching experience that may include:
live coaching sessions;
group calls;
recorded trainings;
accountability support;
digital resources; and
private community access.
Program content, schedules, bonuses, facilitators, and delivery methods may change at any time at the discretion of Face the Change, LLC.
Missed sessions, calls, or events do not roll over and are not eligible for reimbursement, credit, or rescheduling unless explicitly stated otherwise.
10. PAYMENT TERMS
Program pricing and payment options are displayed on the applicable checkout page at the time of purchase.
By enrolling, you agree:
to complete all payments associated with your selected payment plan;
that payment plans are legally binding commitments; and
that failure to complete payments may result in revoked access and collections efforts.
No pauses, freezes, suspensions, or cancellations are guaranteed.
Payment obligations remain in effect regardless of:
participation level;
schedule conflicts;
relocation;
business changes;
personal circumstances;
health challenges; or
decision to discontinue participation.
11. REFUND POLICY
Due to the digital nature of the Program and immediate access to proprietary materials and intellectual property, all sales are final.
No refunds will be issued unless otherwise stated in writing.
Failure to attend sessions, participate, complete the Program, or achieve desired outcomes does not qualify for a refund.
12. CHARGEBACKS AND PAYMENT DISPUTES
By enrolling in the Program, you agree not to initiate chargebacks or payment disputes without first attempting to resolve the issue directly with Face the Change, LLC.
If a chargeback or payment dispute is initiated:
Program access may be revoked immediately;
outstanding balances may become immediately due; and
Face the Change, LLC reserves the right to provide proof of acceptance of these Terms and Program participation to financial institutions or dispute processors.
13. THIRD-PARTY FINANCING
Face the Change, LLC may offer access to third-party financing providers such as Affirm, Klarna, Afterpay, Stripe financing, or similar services.
Any financing agreement is solely between you and the financing provider.
Face the Change, LLC is not responsible for:
financing approvals;
payment schedules;
interest rates;
fees;
financing disputes; or
payment processing issues.
All financing disputes must be resolved directly with the financing provider.
14. RECORDING CONSENT
You understand and agree that Program calls, trainings, coaching sessions, and community events may be recorded for educational, training, quality assurance, or future Program use.
By participating, you consent to the recording and use of your voice, likeness, comments, questions, and participation unless you explicitly request otherwise in writing.
Participants are responsible for maintaining privacy within their own environments while attending live or recorded sessions.
15. TESTIMONIALS AND MEDIA RELEASE
By participating in the Program, you grant Face the Change, LLC permission to use testimonials, written feedback, screenshots, comments, or shared experiences for marketing and promotional purposes.
Personally identifying information will not be shared without consent unless voluntarily made public by you.
You may revoke this consent at any time through written request.
16. NO GUARANTEE OF RESULTS
Face the Change, LLC makes no guarantees regarding:
personal transformation;
emotional outcomes;
symptom-related outcomes;
productivity;
business growth;
financial results;
lifestyle changes; or
performance improvements.
Testimonials and examples are illustrative only and do not guarantee future results.
Outcomes depend on many factors beyond our control, including individual effort, consistency, environment, personal circumstances, and external factors.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Face the Change, LLC shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from:
participation in the Program;
use of Program materials;
emotional distress;
health outcomes;
business losses;
financial losses;
technology failures; or
decisions made based on Program content.
Face the Change, LLC shall not be liable for decisions made to alter healthcare treatment plans, medications, therapies, or medical care based on Program content.
Participation is voluntary and undertaken entirely at your own risk.
18. TECHNOLOGY DISCLAIMER
Face the Change, LLC is not responsible for:
internet outages;
platform failures;
software issues;
technology malfunctions;
hacked accounts;
user technology problems; or
interruptions outside our control.
19. FORCE MAJEURE
Face the Change, LLC shall not be held responsible for delays, interruptions, or inability to perform due to events beyond reasonable control, including but not limited to:
natural disasters;
pandemics;
illness;
emergencies;
internet outages;
cyber-attacks;
labor disputes;
power outages; or
government actions.
20. DISPUTE RESOLUTION AND ARBITRATION
Any dispute arising from this Agreement or participation in the Program shall first be attempted to be resolved through good-faith communication.
If unresolved, disputes shall be resolved through binding arbitration in the State of New York in accordance with applicable arbitration laws.
You waive the right to participate in any class-action lawsuit or class-wide arbitration against Face the Change, LLC.
Each party shall be responsible for its own legal fees unless otherwise required by law.
21. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.
22. MODIFICATIONS TO TERMS
Face the Change, LLC reserves the right to modify or update these Terms and Conditions at any time.
Updated terms become effective immediately upon posting.
Continued participation in the Program constitutes acceptance of revised Terms.
23. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between you and Face the Change, LLC regarding participation in the Program.
24. ACKNOWLEDGMENT
By purchasing, enrolling in, accessing, or participating in the Program, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
